Colorado Division of Oil and Public Safety Adopts Amendments to Storage Tank Regulations

On September 25, 2016 the Colorado Division of Oil and Public Safety within the Department of Labor and Employment adopted amendments to the Storage Tank Regulations 7 C.C.R. 1101-14. The primary purpose of this rulemaking is to make Colorado’s regulations consistent with the 2015 revisions of the federal EPA regulations related to underground storage tanks (USTs) found in 40 CFR part 280 and 281, created pursuant to 42 U.S.C. sec. 6991. amendments-to-colorado-storage-tank-regulations The amendments increase emphasis on properly operating and maintaining UST equipment and attempt to improve detection of UST releases. In addition, the rulemaking is updating a section of Article 1.5 Motor Fuel Dispensing and Product Quality and Article 5 Release Response.  Importantly, just as above, many of the updates call for increased monitoring and reporting of USTs. The new rules become effective on January 1, 2017.
