U.S. EPA Proposes Ohio SIP Requirements Approval

U.S. EPA Proposes Approval of Ohio Air Plan / Infrastructure SIP Requirements for the 2012 PM 2.5

On 23 June, 2016 the U.S. Environmental Protection Agency (EPA) proposed approving multiple elements of Ohio’s state implementation plan (SIP) regarding the infrastructure requirements of section 110 of the Clean Air Act (CAA) for the 2012 fine particulate matter (PM2.5) National Ambient Air Quality Standards (NAAQS).

The elements proposed to be approved are as follows:

  • Section 110(a)(2)(A) Emission Limits and Other Control Measures,
  • Section 110(a)(2)(B) Ambient Air Quality Monitoring/Data System,
  • Section 110(a)(2)(C) Program for Enforcement of Control Measures,
  • Section 110(a)(2)(D) Interstate Transport,
  • Section 110(a)(2)(E) Adequate Resources (ensuring that each state could provide adequate resources and legal authority under state law to carry out its SIP),
  • Section 110(a)(2)(F) Stationary Source Monitoring System,
  • Section 110(a)(2)(G) Emergency Powers,
  • Section 110(a)(2)(H) Future SIP Revisions,
  • Section 110(a)(2)(I) Nonattainment Area Plan or Pan Revisions Under Part D,
  • Section 110(a)(2)(J) Consultation With Government Officials; Pubic Notifications, PSD, Visibility Protections,
  • Section 110(a)(2)(K) Air Quality Modeling / Data,
  • Section 110(a)(2)(L) Permitting Fees,
  • Section 110(a)(2)(M) Consultation / Participation by Affected Local Entities.

With regards to Section 110(a)(2)(F) EPA Stationary Source Monitoring System, EPA is finding that Ohio’s Environmental Protection Agency’s (OEPA) current rules OAC 3745-15 (containing provisions for the submission of emissions reports) and OAC 3745-77 and OAC 3745-31 (providing requirements for recordkeeping by sources) are adequate to meet this element.

Comments must be received by EPA on or before July 25, 2016 and can be submitted online at http://www.regulations.gov referencing Docket ID No. EPA-R05-OAR-2015-0824.
