EPA and Army Corps of Engineers Propose Delaying WOTUS’ Effective Date

On November 16, 2017, EPA and the US Army Corps of Engineers announced that they are proposing to amend the effective date of the 2015 “waters of the United States” rule (WOTUS). The government proposed that the WOTUS rule’s effective date be pushed back to two years after the delay is finalized and published in the Federal Register. EPA and the Corps say they are proposing this delay to provide regulatory certainty while they revise the definition of “waters of the United States.” Once the proposed delay is published in the Federal Register, the agencies will accept public comments for 21 days. Currently, EPA and the Corps of Engineers are reviewing the public comments they received on from their rule proposing to rescind the 2015 WOTUS rule.
