EU Rules on making fertilising products available on the market based on the circular economy have been officially published

EU is going to ensure legal certainty, take advantage of technical developments, and further stimulate the incentive among producers of fertilisers to make more use of valuable waste streams, the setting of recovery requirements at Union level for such products is required. For this purpose, the EU introduces new harmonised conditions for making fertilisers made from recycled or organic materials were established in order to further develop circular economy. This aim has to be ensured by a new Regulation (EU) 2019/1009 of 5 June 2019 laying down rules on the making available on the market of EU fertilising products, which has been published in the EU Official Journal, dated 25th June 2019. Additionally, the EU also amends Annexes I and IV relating to fertilisers of Regulation No. 2003/2003, currently being in force on this matter, by Commission Regulation (EU) 2019/1102 of 27 June 2019. Regulation (EU) 2019/1009 of the European Parliament and of the Council of 5 June 2019 laying down rules on the making available on the market of EU fertilising products This new EU regulation (No. 2019/1009) was preceded by European Parliament legislative resolution of 27 March 2019 on the proposal for a regulation of the European Parliament and of the Council laying down rules on the making available on the market of CE marked fertilising products and amending Regulations (EC) No 1069/2009 and (EC) No 1107/2009. The new Regulation (No. 2019/1009) contains clear obligations for each economic operator in the supply chain of EU fertilising products (including packaging and repackaging by importers and distributors), defines fertilising products (the requirements for the relevant product function category, component material category or categories and the labelling requirements) and sets rules for the conformity of these products with harmonised standards (drawing up the technical documentation and carry out the relevant conformity assessment procedure and CE marking). This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union. It shall apply from 16 July 2022 and Regulation (EC) No. 2003/2003 is repealed with effect from 16 July 2022. Commission Regulation (EU) 2019/1102 of 27 June 2019 In the meantime, Commission Regulation (EU) 2019/1102 introduces an amendment of Regulation No. 2003/2003 as follows:
  • in Table F.1 of Annex I – adding position of: Isomeric mixture of 2-(3,4-dimethylpyrazole-1-yl)-succinic acid and 2-(4,5-dimethylpyrazole-1-yl)-succinic acid (DMPSA) EC No 940-877-5),
  • in Annex IV – Section B is amended in scope of Methods 1, 9, 10 and 12.
