EPA to Revise the Current Size Standards for Small Manufacturers and Processors that Determine TSCA Reporting Requirements

On November 30, 2017, the Environmental Protection Agency (EPA) published a notice in the Federal Register announcing that it will revise the size standards for small manufacturers and processors that determine reporting requirements under the Toxic Substances Control Act (TSCA). The notice follows a public comment period that began on December 15, 2016, when the EPA requested comments on whether such a revision is necessary, and another public comment period on the topic that opened May 9, 2017. After considering the comments it received, the EPA has determined that an update of the current standard, which was last revised in 1988, is warranted.
