In a press release issued on 25 August 2014, the Occupational Safety and Health Administration (OSHA) and the National Institute for Occupational Safety and Health (NIOSH) released Recommended Practices for staffing agencies and host employers aiming to protect temporary workers’ safety and health. The main recommendations are that the staff agency/host employer contracts clearly define the tasks of the temporary worker as well as the safety and health responsibilities of each employer, and that temporary workers receive the same training and protection that existing workers receive.
As a reminder, Directive 2014/67/EU of 15 May 2014, published in the Official Journal of the European Union (OJEU) L 159 of 28 May 2014, established provisions, measures and control mechanisms aiming to ensure a better and more uniform implementation, application and enforcement in practice of Directive 96/71/EC of 16 December 1996 concerning the posting of workers in the framework of the provision of services. The new framework includes measures to prevent and sanction any abuse and circumvention of applicable rules under Directive 96/71/EC.
