US | EPA Publishes 2020 Annual Plan for Chemical Risk Evaluations under TSCA

Priority Substances

The Annual Plan states that in fiscal year 2020, EPA intends to complete final risk evaluations for the first ten chemicals:

1. 1, 4‐Dioxane
2. Methylene Chloride
3. 1‐Bromopropane (1-BP)
4. N‐ Methylpyrrolidone
5. Asbestos
6. Pigment Violet 29
7. Carbon Tetrachloride
8. Trichloroethylene
9. Cyclic Aliphatic Bromide Cluster (HBCD)
10. Tetrachloroethylene

In June 2020, EPA plans to release final draft scope documents for the 20 high-priority substances designated in December 2019. In the third quarter of fiscal year 2020, EPA expects to release draft scope documents for diisodecyl phthalate (DIDP) and diisononyl phthalate (DINP). EPA also expects to ask for public comments and make a final determination whether to grant a request to conduct a risk evaluation on octamethylcyclotetrasiloxane (D4) within fiscal year 2020. Finally, EPA expects to begin its process to review fees to defray 25 percent of the costs for implementing TSCA Sections 4, 5, 6, and 14. EPA also plans to propose certain exemptions to the current fee rule’s self-identification requirements associated with risk evaluations for manufacturers that:

• Import the chemical substance in an article
• Produce the chemical substance as a byproduct
• Produce or import the chemical substance as an impurity
