Florida DEP Proposes Incorporating Federal Hazardous Waste Rules into State Hazardous Waste Rules
On 11 July, 2016, the state of Florida Department of Environmental Protection (DEP) proposed incorporating various federal hazardous waste program rule changes into Florida’s state hazardous waste regulations in order to maintain consistency with the federal regulations.
Florida’s hazardous waste rule can be found at Chapter 62-730, F.A.C. Specifically, Florida will be making these incorporations to 62-730.021. The federal waste rules incorporated will include:
- 40 CFR Part 260.11 (except for the optional amendments to 260.11(c)(1)
- 260.11(c)(3)(xxvii), and 260.11(d)(1))
- 40 CFR Parts 260.20-23, 260.30-34, and 260.40-43.
Per the Florida DEP, substantially affected persons may within 14 days of the date of this notice file an objection to the rule-making with the agency. The objection shall specify the portions of the proposed rule to which the person objects and the specific reasons for the objection.
