In a press release dated 16 June 2014, the European Chemicals Agency (ECHA) announced that four new substances of very high concern (SVHCs) were added to the Candidate List. This list includes substances for possible inclusion in Annex XIV (List of substances subject to authorisation) to Regulation (EC) No 1907/2006 of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH). The Candidate List currently contains 155 substances.
The four substances identified as SVHCs are the following:
• Cadmium chloride • 1,2-Benzenedicarboxylic acid, dihexyl ester, branched and linear • Sodium peroxometaborate • Sodium perborate To note, companies’ legal obligations resulting from the identification of the new SVHCs shall apply to the substances on their own, in mixtures or in articles. Producers and importers of articles containing any of the abovementioned substances are required to notify ECHA before 16 December 2014, if both of the following conditions apply: “- the substance is present in those articles in quantities over one tonne per producer or importer per year, and – the substance is present in those articles above a concentration of 0.1% weight by weight”. However, there are also exemptions from this notification obligation, which apply when the substance has already been registered for the use or when exposure to the substance can be excluded. A summary of obligations resulting from inclusion in the Candidate List of SVHCs for authorization is also available on ECHA’s website.
