These are the Unauthorised Deposit of Waste (Fixed Penalties) Regulations 2016 (S.I. 2016 No 334) which come into force on 9th May 2016.
These regulations amend the Environmental Protection Act 1990 (C. 43) to insert fixed penalty fines.
The contravention of s.33(1)(a) of the Environmental Protection Act 1990 which prohibits a person from unauthorised depositing of controlled waste or extractive waste in or on any land unless in accordance with an environmental permit.
The new fine structure dictates that a fine not less the £150 and not more than £400, to be specified by the waste collection authority and in the absence of any specified fine a penalty of £200.
An impact assessment was conducted and stated that no impact on the costs of business.
