The US EPA Proposes Procedures for Review of CBI Claims for the Identity of Chemicals in TSCA Inventory
In the April 23, 2019 Federal Register, US EPA proposed procedures to review Confidential Business Information (CBI) claims under the Toxic Substances Control Act (TSCA) as required by the July 2016 amendments to the act. Under TSCA, when EPA seeks to obtain information on regulated chemicals, companies can request that confidential proprietary information believed to give other companies an advantage in the marketplace not be released. The proposed rule will require companies to provide certain amounts of information (as detailed in 40 CFR § 710.37(c)(1) and (2)) to substantiate their claims, but will exempt certain types of manufacturers. EPA will use the procedures and standards found in 40 CFR 2 to approve or deny claims. If accepted, the claimed information will be protected for 10 years. Comments in response to this proposal must be submitted by June 24, 2019.
