MoEFCC amends Battery Waste Management Rules, 2022

These rules may be called as Battery Waste Management (Amendment) Rules, 2023.

The key features are:

Definition of Battery has changed: Battery’ means new or refurbished cell or Battery, including accumulator, which is any source of electrical energy generated by direct conversion of chemical energy and includes disposable primary or secondary battery.
Extended Producer Responsibility applicable to Producer for the Battery that they introduce in the market and the ones put to self-use. This is to ensure the recycling or refurbishing as per Schedule II.
Annual returns in Form 3 pertaining to pre-consumer waste battery generated in the preceding financial year, must be filed by the Producer.
Every Producer should obtain registration from the Central Pollution Control Board through online centralized portal.
A return must be furnished by the Producer regarding the Battery manufactured or assembled or imported in the preceding financial year in Form 1(C) to the Central Pollution Control Board on or before the 30th June of every year.
Total weight of waste battery processed by entity involved in recycling of waste Battery, on quarterly basis, should made be available on the online portal.
