US | Illinois: IEPA Adopts PSD Permitting Program Rules

Pollution Control
In the September 18, 2020 the Illinois Environmental Protection Agency (IEPA) published its adoption of a new Part 204, creating rules for a Prevention of Significant Deterioration (PSD) permitting program, with the intent that US EPA will allow Illinois to directly administer the program and allow the Pollution Control Board (PCB) to assume responsibility for appeals of PSD permits issued by IEPA. In addition to adopting Part 204, IEPA also amended the PCB’s procedural rules to accommodate Part 204 and PSD permit appeals. The rules are not incorporations by reference, by state-specific rules, although the substantive requirements are closely aligned with the federal PSD rules. The rules became effective on September 4, 2020.
