In the February 7, 2019 Federal Register, the Environmental Protection Agency (EPA) proposed revising its Mercury and Air Toxics Standards for power plants. EPA’s proposal finds that it is not “appropriate and necessary” to regulate hazardous air pollutants (HAPs) from coal- and oil-fired electric utility steam generating units (EGUs), because EPA erroneously included co-benefits when calculating the benefits of regulation. Co-benefits are the benefits from the reduction of pollutants other than those specifically in the rulemaking, in this case, mercury. Future rulemakings may be impacted if co-benefits are no longer counted. Public comments will be accepted through April 8, 2019.
