US EPA Proposes Modifications to NSPS and Emissions Guidelines for Commercial and Industrial Solid Waste Incineration Units

In the June 15, 2018 edition of the Federal Register the US EPA proposed modifications to the New Source Performance Standards (NSPS) and emissions guidelines (EG) for commercial and industrial solid waste incineration units (CISWI). Comments in response to this proposal must be received by July 30, 2018. These changes will impact 40 CFR 60 Subparts CCCC and DDDD. The changes will include the following: adoption of an alternative equivalent emission limit for mercury for the waste-burning kiln subcategory; extension of the date of initial test and initial performance from 60 days to 180 days from the final compliance date for affected sources; extension of the electronic data reporting requirement to 2 years from 1 year; clarification of non-delegated authorities; permission for sources to use CEMS data as an initial compliance demonstration alternative to an emissions test provided that the initial CEMS performance evaluation has been conducted prior to collecting CEMS data used for the initial performance tests as well as clarification and streamlining of CEMS requirements found in tables; clarification of continuous opacity monitoring system requirements; clarification of CEMS requirements in order to indicate that CO CEMS are not required for new source waste-burning kilns and the removal of outdated notification requirements when PM CEMS are being used; clarification of reduced testing requirements with regards to sources that have demonstrated good performance and have skipped testing for 2 years; clarification of deviation reporting requirements for continuous monitoring data; clarification that air curtain incinerators (ACIs) do not meet the definition of CISWI to be subject to the CISWI rule.
