[UK] Amendments to hazardous waste legislation

The Hazardous Waste (Miscellaneous Amendments) Regulations 2015 come into force on 1 July 2015 and some of the regulations apply to England only. The Regulations make minor amendments to legislation which either relates to or refers to hazardous waste. They also revoke two other sets of regulations.

What are the texts amended by the Hazardous Waste (Miscellaneous Amendments) Regulations 2015 ?

The texts amended by the Hazardous Waste (Miscellaneous Amendments) Regulations 2015 are :

  1. the Environmental Protection Act 1990
  2. the Hazardous Waste (England and Wales) Regulations 2005
  3. the Batteries and Accumulators (Placing on the Market) Regulations 2008
  4. the Cremation (England and Wales) Regulations 2008
  5. the Waste Batteries and Accumulators Regulations 2009
  6. the Environmental Permitting (England and Wales) Regulations 2010
  7. the Waste (England and Wales) Regulations 2011
  8. the Controlled Waste (England and Wales) Regulations 2012

Amendments made to ‘List of Wastes‘ EU directives and other modifications …

Among the amendments made by the 2015 Regulations, references to Directive 2008/98/EC have been modified to take into account amendments made by Commission Regulation (EU) No 1357/2014. Equally, amendments made to ‘List of Wastes‘ EU directives by Commission Decision 2014/955/EU are reflected in the changes. Further amendments are a result of enactments following WEEE Directive 2012/19/EU.

The regulations revoked by the Hazardous Waste (Miscellaneous Amendments) Regulations 2015 are:

  1. the List of Wastes (England) Regulations 2005
  2. the List of Wastes (England) (Amendment) Regulations 2005
