US EPA Adopts New TSCA Fees

In the October 17, 2018 edition of the Federal Register the US EPA announced that it had adopted new fee requirements under the Toxic Substances Control Act (TSCA) regulations found in 40 CFR 700. These modifications establish fees for the following manufacturers and importers: those who are required to submit information under section 4 of TSCA, those who submit certain notices and exemption requests to EPA under section 5 of TSCA, and those who make a chemical substance that is subject to a risk evaluation under TSCA section 6(b)(4). The fees also apply to processors of chemical substances that are the subject of a Significant New Use Notices (SNUNs) or Test Market Exemptions (TMEs) under section 5 of TSCA and who are required to submit information under section 4 of the act related to a SNUN submission. This final rule also describes the fees and fee categories for fiscal years 2019, 2020, and 2021. The rule becomes effective on October 18, 2018.
