US EPA Publishes Notification of Guidance and Stakeholder Meeting for July 20, 2015 SNAP Final Rule

In the April 27, 2018 edition of the Federal Register, the US EPA published a notification of guidance and a stakeholder meeting for the July 20, 2015 Significant New Alternatives Policy Program final rule and the decision of the Court of Appeals for the District of Columbia Circuit in Mexichem Fluor, Inc. v. EPA. The stakeholder meeting is scheduled for May 4, 2018.
The 2015 rule changed the listings for certain hydrofluorocarbons in various end-uses in the aerosols, refrigeration and air conditions, and foam blowing sectors and certain hydrochlorofluorocarbons being phased out of production under the Montreal Protocol on Substances that Deplete the Ozone Layer and section 605 of the Clean Air Act. The court vacated the 2015 Rule “to the extent it requires manufacturers to replace HFCs with a substitute substance” and remanded the rule to EPA for further proceedings. In its guidance, EPA is affirming that it will not apply the HFC listings in the 2015 rule, but is in the process of creating a new rule. The stakeholder meeting will be held on May 4, 2018 and will allow stakeholders to provide input as the Agency prepares to engage in rulemaking to address the remand. The meeting will be held at 9:30 AM to 12:30 PM ET at the William Jefferson Clinton East Building, Room 1153, 1201 Constitution Avenue NW, Washington, DC 20004.
