EPA and Army Propose Applicability Date for 2015 Waters of the United States Rule to Provide Regulatory Certainty While Rule is Assessed

On November 22, 2017, a proposed rule was published in the Federal Register in which the Environmental Protection Agency (EPA) and the Department of the Army proposed to add an applicability date for the 2015 Waters of the United States (WOTUS) Rule, which was adopted in 2015 and stayed later that year. If adopted, the 2015 WOTUS Rule’s definition of “waters of the United States” would be applicable two years after the date that the proposal is adopted. The proposed rule is intended to maintain the status quo and provide regulatory certainty while the WOTUS Rule is assessed for potential revisions, consistent with President Trump’s Executive Order entitled “Restoring the Rule of Law, Federalism, and Economic Growth by Reviewing the `Waters of the United States’ Rule.” Comments on the proposed rule must be received on or before December 13, 2017.
