On September 6, 2017 the Indiana Department of Environmental Management (IDEM) proposed changes to the legal notice provisions for permits issued under the New Source Review (NSR) and Title V permit programs. The changes will be consistent with the federal EPA changes to both programs, which became effective on November 17, 2016. This final rule removed the mandatory requirement to provide public notice of certain draft air permits through publication in a newspaper. Instead, the rule requires the publication of an electronic notice for draft permits and actions issued by the federal EPA or any authorities implementing its federal permitting rules. The Indiana proposal will be identical.
