Indiana: Indiana Department of Environmental Management Proposes Amendments to New Source Review and Title V Permit Programs

On September 6, 2017 the Indiana Department of Environmental Management (IDEM) proposed changes to the legal notice provisions for permits issued under the New Source Review (NSR) and Title V permit programs. The changes will be consistent with the federal EPA changes to both programs, which became effective on November 17, 2016. This final rule removed the mandatory requirement to provide public notice of certain draft air permits through publication in a newspaper. Instead, the rule requires the publication of an electronic notice for draft permits and actions issued by the federal EPA or any authorities implementing its federal permitting rules. The Indiana proposal will be identical.

Comments can be sent by mail to LSA Document #17-395 Electronic Notice for Air Permits, Keelyn Walsh, Rules Development Branch, Office of Legal Counsel, Indiana Department of Environmental Management, Indiana Government Center North, 100 North Senate Avenue, Indianapolis, IN 46204, by facsimile to 317-233-5970, or by email to kwalsh@idem.in.gov. The deadline for submissions is October 6, 2017.
