Guidance on Waste Incineration [UK]

The Department for Environment, Food and Rural Affairs (DEFRA) has published the Consultation outcome – Waste incineration guidance: proposed amendments on its webpage.

The resulting guidance has also been published and is linked below.

The consultation was seeking views on whether the proposed changes to the guidance on waste incineration which affect Small Waste Oil Burners (SWOBs) were clear before they were implemented.

The changes would mean that SWOBs fall under Chapter IV of the Industrial Emissions Directive (IED).

The consultation states that the key points identified by respondents are:

  • Four respondents noted that the revisions did not reference the relevant section of the Industrial Emissions Directive (IED) and should clarify what types of permit would be required under the regulations and who the relevant regulator would be.
  • Two respondents noted that the requirements in the revised guidance may not be clear to SWOBs operators.
  • One respondent requested that the guidance should provide greater clarity on whether SWOBs could be considered to be a container lacking ‘technical sophistication’ and details of which SWOBs would fall within this category.
  • One respondent noted that the revised guidance is clear that IED applies to SWOBs but not what the implications are for business.

In conclusion the government has amended the guidance to take account of various concerns raised by the respondents.

The changes which the government have made are detailed in the consultation response document.

The impact assessment is available on the consultation webpage.

The new guidance which details the changes for small waste incineration plants (SWIPs) and small waste oil burners (SWOBs) is available via the “Waste Incineration Guidance” link below.
