EPA Proposes Revised Greenhouse Gas Reporting Requirements [US]

On December 21, 2015, the U.S. Environmental Protection Agency (EPA) proposed significant changes to its greenhouse gas (GHG) reporting program under the Clean Air Act.

The proposed amendments, which make changes to 30 subparts in 40 CFR Part 98, are intended to:

  • streamline implementation of the Greenhouse Gas Reporting Rule,
  • improve data collection,
  • update the rule with revised industry practices and
  • make technical corrections.
A public notice and comment period will be announced when the EPA publishes the proposed rule in the Federal Register.

Under 40 CFR Part 98, facilities that emit 25,000 metric tons or more of carbon dioxide equivalent per year must annually report GHG emission data to the EPA.

The EPA is proposing to amend 30 subparts of the rule to require facilities to report additional or different GHG emission data, depending on the industry category.

This proposed rulemaking would revise the reporting requirements that such facilities must follow by updating the rule with new data collection methods and procedures to reflect current industry processes and emissions.

Clarifying text and corrections have also been included in the proposed rules.  In addition, the rulemaking proposes confidentiality determinations for reporting certain GHG emission data.

A public comment period consisting of a public hearing and a deadline for submitting written comments to the EPA will be announced when the rule is published in the Federal Register.

If adopted, the rule will be implemented in phases during 2016, 2017, and 2018.
