South Carolina: The Department of Health and Environmental Control proposes amendments to its hazardous waste regulations [US]

In November 27, 2015 South Carolina State Register, the Department of Health and Environmental Control (DHEC) proposed amending R.61-79, Hazardous Waste Management Regulations. The proposed changes would federal rules adopted in the Federal Register.

The first amendment excludes hazardous carbon dioxide streams from hazardous waste regulations, provided that these streams are captured from emission sources, are injected into Underground Injection Control Class VI wells for sequestration, and meet other conditions. The regulations were initially published in the Federal Register on January 3, 2014 on pages 350-364.

The second amendment proposes adopting recycling-related revisions to the definition of solid waste. The revised definitions are intended to encourage the recycling of hazardous secondary material while protecting human health and the environment. The regulations were initially proposed in the January 13, 2015 Federal Register on pages 1694-1814.

Additionally, DHEC proposes adopting the federal rule permitting electronic hazardous waste manifests. Adopting this rule will bring South Carolina into conformity with federal law.

DHEC also proposes adopting the revisions to the export provisions of cathode rat tubes, to permit DHEC to better track exports of cathode ray tubes for reuse and recycling.

Public comments will be accepted through December 29, 2015.
