Virginia State Air Pollution Control Board fast-tracks amendments [US]

The Virginia State Air Pollution Control Board fast-tracks proposed amendments to the Permits for Stationary Sources. The amendments aim ensure the Virginia regulation conform with federal requirements.

The Virginia State Air Pollution Control Board is proposing amendments to the Permits for Stationary Sources and Permits for Stationary Sources of Pollutants Subject to Regulation in order that the Virginia regulation conform to federal requirements for major New Source Review (NSR) program.

The Virginia State Air Pollution Control Board’s proposition

 
  1. Amend the definition of “baseline actual emissions” to allow a 10-year lookback period instead of the existing 5-year period, and to allow the use of different lookback periods for various regulated NSR pollutants;
  2. Amend Plantwide Applicability Limits (PAL) requirements to 10 years instead of the current 5 years;
  3. Amend the definition of “emissions unit” and add a definition of “replacement unit” to allow use of baseline actual emissions of the unit being replaced and the projected emissions of the replacement unit.

The main goals of those changes?

 

The proposed changes are supposed to provide more flexibility to permit applicants and reduce number of permit applications and revisions. It is estimated that approximately 300 sources may be able to utilize this proposed NSR.

No public hearing is scheduled for the proposal and the public comment period ends on 29th July, 2015. The proposed amendments will be in effect from 13th August, 2015.
