[EU] EC to amend or withdraw several EHS legislative proposals

In a press release issued on 16 December 2014, the European Commission (EC) announced the adoption of its Work Programme for 2015, setting out the actions the EC intends to take over the next 12 months. The Programme includes 23 new Environment Health & Safety (EHS) initiatives and 80 existing EHS proposals which the EC proposes to withdraw or amend for political or technical reasons.

European Commission Environment Health and Safety  proposals

One of the proposals that the EC intends to amend is the proposal for the reduction of national emissions of certain air pollutants. The EC intends to include it in the 2030 Energy and Climate Package. Furthermore, EC intends to withdraw the proposal for a Directive amending the EU legislation on waste management, belonging to the “circular economy” package. However, this proposal should be replaced by the end of 2015 by a new proposal, more ambitious.

Modifications of pending EHS proposals         

Fifteen other proposals are intended to be removed (Annex II). The EC justifies these withdrawals by the fact that:
  •  There are institutional blockages:  proposals are of no use if the negotiation process tends not to come to an end or if they come out so distorted that they cannot achieve their initial objective;
  • There are proposals which have become totally obsolete.

Modifications due to institutional blockages distorting the initial EHS proposals:

 
  • Proposal for a Regulation on organic production and labelling of organic products
  •   Proposal for a Regulation establishing a Community system for registration of carriers of radioactive materials
  • Proposal for a Directive amending Directive 2003/96/EC restructuring the Community framework for the taxation of energy products and electricity
  • Proposal for a Regulation on the establishment of a fund for the compensation of oil pollution damage in European waters and related measures
  • Proposal for a Directive on aviation security charge

Withdrawals due to obsolescence:

 
  • Proposal for a Directive on uniform procedures for checks on the transport of dangerous goods by road (codified version)
  • Proposal for a Regulation on waste statistics (Codified version)
  • Proposal for a Regulation on common rules for the allocation of slots at Community airports (Codified version)
  • Proposal for a Directive on the classification, packaging and labelling of dangerous preparations (Recast)
However, the EC will expect the opinion of the European Parliament before formally withdrawing the proposed texts, considering its view as being “imperative”.

The new EHS initiatives 

Besides these withdrawals, the Work Programme for 2015 also includes 23 new initiatives (Annex 1). Although based primarily on employment, growth and investment, one of the proposals, however, aims to create a European Energy Union to ensure security of energy supply, reducing Europe’s energy demand and “decarbonising” the energy mix.
