REACH: new test methods for the determination of toxicity [EU]

Regulation (EU) No 900/2014 of 15 July 2014 amends, for the purpose of its adaptation to technical progress, Regulation (EC) No 440/2008 laying down test methods pursuant to Regulation (EC) No 1907/2006 of 18 December 2006 on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH). The amendments aim to include with priority new and updated test methods recently adopted by the Organisation for Economic Co-operation and Development (OECD).

Thus, the Annex to Regulation (EC) No 440/2008 is amended in order to include six new test methods for the determination of toxicity and other health effects.

As a reminder, in a press release dated 30 June 2014, the European Chemicals Agency (ECHA) published the conclusions of the European Ombudsman concerning ECHA’s interpretation on animal testing. The Ombudsman concluded that an incomplete registration dossier may comply with REACH Regulation (Regulation (EC) No 1907/2006 of 18 December 2006 concerning the Registration, Evaluation and Authorisation of Chemicals and Restriction of Chemicals), if the safety of the substance was previously established during compliance checks. Indeed, some tests may not be required if compliance checks demonstrated the safety of the substance. If this is not the case, then further testing may be requested from the registrant.
