Hazardous Waste Amendment Regulations [UK]

These are the Hazardous Waste (England and Wales) (Amendment) Regulations 2016 (S.I. 2016 No.336) (“the 2016 Regulations”) which come into force on 1st April 2016.

The 2016 Regulations amend the Hazardous Waste (England and Wales) Regulations 2005 (“the 2005 Regulations”).

The main purpose of these regulations is to implement a deregulation change that will no longer require premises where hazardous waste is produced or removed from to register with the environment agency.

The 2016 Regulations specifically revoke Part 5 of the 2005 Regulations which removes the requirement for hazardous waste producers to register with the Environment Agency.

Schedule 1 of the 2016 Regulations contains the new form of consignment note which replaces Schedule 4 of the 2005 Regulations.

Schedule 2 of the 2016 Regulations contains the new Schedule of Carriers Certificate (which replaces schedule 5 of the 2005 Regulations).

The Environment Agency has sent out guidance in respect of the new consignment notes and process which is linked to this alert below in pdf format.

In addition to the pdf guidance all hazardous waste guidance has been updated on the Environment Agency’s webpage to account for the removal of registration requirement for hazardous waste producers from 1st April 2016.
