Scotland drafts ban on wet wipes containing plastic for consumers

On 23 January 2026, the Scottish Government published a notice in The Gazette on draft regulations to prohibit persons from supplying or offering to supply wet wipes containing plastic in Scotland.
Any person may make representations on the legislation in writing before 6 February 2026.
The regulations are expected to come into force 18 months after being signed.
The Draft Environmental Protection (Wet Wipes Containing Plastic) (Scotland) Regulations 2026 applies in Scotland to any organisation supplying wet wipes containing plastic to consumers. Wet wipes are pre-wetted, non-reusable fabrics. Plastic includes synthetic polymers forming the main structure of the product.
Proposed requirements and offences
- Supplying wet wipes containing plastic to end users in business would be an offence.
- Fines could reach the maximum for summary offences.
- Local authorities could authorise officers to enter premises, inspect documents, take samples, and request assistance.
Exemptions
- Retail pharmacies: sales only on request, kept out of view, no advertising in Scotland; online sales allowed.
- Medical use: allowed for health care professionals for prevention, diagnosis, research, or treatment.
- Supply to businesses or local authorities for operational purposes is allowed.
Liability and enforcement
- Corporates and individuals in charge could be liable if offences occur through consent, neglect, or connivance.
- Defence is possible by demonstrating all reasonable precautions and due diligence.
- Fixed penalties apply.
Timeline and next steps
- Draft intended for 2026 introduction; exact entry into force not confirmed.
- Businesses should review product lines, plan storage and sales controls, and prepare records for compliance once the regulation is enacted.
Wales, England and Northern Ireland have published Regulations which enter into force in December 2026 and May 2027. When the Scotland draft is passed restrictions will be in place for all of UK.
