EPA Withdraws Direct Final Rule Regarding 2017 TRI NAICS Code Revision, Continues with Proposed Rule

In the November 14, 2017 Federal Register, EPA withdrew its direct final rule amending the list of NAICS codes subject to reporting under the Toxics Release Inventory (TRI). EPA will continue to move ahead with the proposed rule published the same day as the direct final rule on August 17 2017.
EPA is withdrawing the direct final rule amending the list of 2017 NAICS codes required to submit a TRI report due to a relevant adverse comment it received during the comment period. At the time EPA published the direct final rule, it also published a proposed rule. EPA will proceed with a final rule based on the proposed rule after it has considered all public comments. The adverse public comment supported the update, but noted that the direct final rule omitted one of the covered NAICS codes updated by the Office of Management and Budget (OMB).
