EPA Delays Effective Date of Risk Management Program (RMP) Amendments Until Feb. 2019

On June 14, 2017, the EPA published a final rule delaying the effective date of the Clean Air Act’s Risk Management Program (RMP) Amendments for twenty months, until February 19, 2019. The RMP Amendments rule was issued on January 13, 2017 and the effective date has since been delayed twice. The purpose of the 20-month delay is to allow the EPA time to reconsider the RMP Amendments, consider additional issues, and then take further regulatory action. The delay affects two of the RMP Amendments’ compliance dates, the first of which was to be March 18, 2018, and it does not specify new compliance dates because the EPA plans to propose amendments to those dates in future regulatory actions.
