OSHA Proposes to Amend Beryllium Rule for Construction and Shipyard Sectors

On June 27, 2017, the Occupational Safety and Health Administration (OSHA) published a proposed rule in the Federal Register regarding the application of the recently implemented beryllium rule to the construction and shipyard sectors. OSHA proposes to revoke the ancillary provisions for those two sectors while keeping the new lower permissible exposure limit (PEL) of 0.2 μg/m3 and the short term exposure limit (STEL) of 2.0 μg/m3. The proposed rule also states that, while rulemaking relating to the proposal is underway, OSHA will not enforce the beryllium rule’s construction and shipyard standards without prior notice. Comments on the proposed rule must be submitted before August 28, 2017. The Occupational Exposure to Beryllium and Beryllium Compounds was published in the Federal Register on January 9, 2017 and, after a few delays, became effective on May 20, 2017. However, compliance obligations do not begin until March 12, 2018.
