Kansas: Department of Health and Environment Announces Public Hearing Date for Proposed Changes to Annual Emissions Fees and Application Fees for Air Permits

On September 7, 2017 the Kansas Department of Health and Environment (KDHE) announced a hearing date of November 15, 2017 for the proposed revocation of K.A.R. 28-19-202 and the adoption of proposed amended regulations to K.A.R. 28-19-516 and 28-19-517, all regarding the state’s Part 70 Operating Permit Program. This proposal will revoke K.A.R. 28-19-202, which requires permittees to pay an annual fee, and combine this requirement with the annual emissions inventory requirements of K.A.R. 28-19-517 under the Class I Operating Permit regulations. K.A.R. 28-19-516 will be changed to increase all application fees to supplement the Class I Operating Permit Program Fee schedule. The change will also eliminate the reduction of fee by the amount paid in annual emission fees. The change to K.A.R. 28-19-517 will require sources that are required to submit an annual emission inventory pursuant to this section pay increased emission fees of $53.00 per ton for calendar year 2018 and beyond. Further changes to this section, will include the option for an electronic submittal or paper submittal. As stated above, the hearing date is scheduled for November 15, 2017 at 10:00 AM in the Flint Hills Conference Room, third floor, Curtis State Office Building, 1000 SW Jackson, Topeka, Kansas.
