On 16th February 2017, the Department for Business, Energy and Industrial Strategy has published an Open Consultation on transposition of the Environmental Impact Assessment Directive: Regulations on Electricity Works. This consultation invites comments on proposals for implementing amendments to the European Union Directive on environmental impact assessment in so far as the Directive applies to the Electricity Works Regulations.

The topic of the consultation is the proposed approach to implementing European Directive 2014/52/EU amending Directive 2011/92/EU on the assessment of the effects of certain public and private projects on the environment.

The consultation seeks views on draft Regulations which will replace the existing Regulations implementing the requirements of the Environmental Impact Assessment Directive insofar as they apply to consents under sections 36 and 37, and variations under section 36C, of the Electricity Act 1989.

These proposals relate to England and Wales, the territorial sea adjacent to England and Wales and the Renewable Energy Zone (other than an area in relation to which the Scottish Ministers have functions).

As a European Union measure with no gold -plating, this is a Non-Qualifying Regulatory Provision (NQRP) under the Better Regulation Framework.

This consultation will last for 4 weeks from 16 February 2017.
