West Virginia Adopts New Rules Covering Permits for Construction, Modification, Relocation and Operation of Stationary Sources of Air Pollutants
On August 26, 2016 the West Virginia Division of Air Quality adopted a new rule governing Permits for Construction, Modification, Relocation and Operation of Stationary Sources of Air Pollutants.
The new rule changes language found in 45 C.S.R. 13 and includes:
- Deletes former rules section
- Revises modification and stationary source definitions to make clear that greenhouse gases cannot trigger a permitting event due to existing threshold limits
- Adds store on site and WVDEP/DAQ webpage definitions
- Changes the applicability for Class I administrative updates to no increase in emissions
- Changes applicability of Class II administrative updates to an increase in emissions
- Clarifies store on site requirements
- Deletes section 5.8
- Revises public review requirements
- Clarifies section 10
- Revises the inconsistency between rules section to include only DAQ
- Makes other miscellaneous clarifications and updates references.
